The High Court heard that investors who gave hundreds of thousands of euros to a Christmas tree planting enterprise fear they were defrauded. Following queries on behalf of several investors, Mr Justice Michael Quinn heard that places, where Christmas trees were meant to be planted, had no trees, and WFS had no interest in the lands concerned. Mr Kearney’s counsel, instructed by Peter Boyle & Co Solicitors, said the alleged issues bringing rise to the application are “significant” and there is a public interest in appointing an inspector.

A number of alleged investors in the scheme have claimed that WFS Forestry Ireland Ltd, with registered offices in Pembroke Street, Dublin 2, has failed to deliver the high returns they were promised. The company and its director Craig Hands deny the allegations.

The group of investors, represented by ourselves at Peter Boyle & Co Solicitors, are asking the court to appoint inspector Declan de Lacy of accountancy firm PKF O’Connor, Leddy & Holmes. We also want an order directing the inspector, if appointed, to report on whether the affairs of the company have been conducted with an intent to defraud creditors, for a fraudulent or unlawful purpose, or in a manner that unfairly prejudices some or all of its creditors.
